At exactly 10.06 am Director Nnamdi arrived at the court.
The judge read out the application and complained as to why the defense should appeal against his acceptance of masked witnesses.
He also said that the
application for stay of proceedings shall not be entertained as he put
it, that could bring hitches in the case.
Justice John Tsoho said that applicants argued that the stay of proceedings is an adjunct to the constitution of the federal republic of Nigeria and cannot stand.
Justice John Tsoho said that applicants argued that the stay of proceedings is an adjunct to the constitution of the federal republic of Nigeria and cannot stand.
But he [John Tsoho] disagreed with the applicants that the
stay of proceedings should be granted. He said that he hope the
applicants will not see this as a case of superiority. He ruled that the
applicant's application shall not be entertained and on that note, he
struck out the application.
So as it stands now, judge John Tsoho has stood his ground that masked witnesses will be entertained at the next hearing of the case to testify against Nnamdi Kanu, irrespective of the fact that his ruling is being challenged against at the court of appeal.
At this point, Justice John Tsoho adjourned the case to the 21st. 22nd. 23rd, and 24th June 2016.
